These terms apply to Nyxialith OS, the game Elsewhere, and your Nyxia ID, operated by Heiko Trenkle. Provider and contact details are in the Imprint. How we handle your data is explained in the Privacy Policy. Browsing nyxia.ai needs no account and is not subject to these terms beyond the law.

1. Your Nyxia ID

You sign in through a supported identity provider; the resulting Nyxia ID is your account for every Nyxia product. You must be at least 16 to create a Nyxia ID. Nyxialith OS requires you to be at least 18. Keep your account access secure; you are responsible for activity under your account.

Do not use our products unlawfully, infringe others' rights, distribute malware, or bypass security, usage limits or game rules. We may restrict access where reasonably necessary to address abuse or protect our products and other users.

You can stop using our products at any time. Deleting your Nyxia ID removes your account and your data in every product, as described in the Privacy Policy.

2. Nyxialith OS

You must be at least 18 to use Nyxialith OS.

// Free testing phase

Nyxialith OS provides AI-assisted chat and creative tools. Purchases are disabled during testing. Catnip provided for testing is a usage allowance, not money, and cannot be redeemed for cash. Testing does not enrol you in a paid service or authorise future charges.

The service is under development. Features may be unavailable or change as we test them. AI output can be inaccurate or unsuitable; review it before relying on it and keep your own copies of important work.

// Your content

You retain your rights in prompts and uploads. You allow us to host, transmit, process and display them as needed to provide the service. Only submit content you are entitled to use. Subject to applicable law and third-party rights, we assign to you any rights we may hold in output generated for you. Output may not be unique or eligible for copyright protection.

3. Elsewhere

// Preview

Elsewhere is in preview. The world, the rules and your progress may change while we build it, and progress may be reset during the preview.

// Relics, battery and other game items

Relics, battery charge and every other item or resource in the game are parts of the game. They are licensed to you for use in Elsewhere; you do not own them.
They have no monetary value, cannot be exchanged for money, and cannot be transferred or sold to other people.
Their effects and availability are part of the game design and may change.

// Fair play

Do not use cheats, automation, or exploits, and do not modify the game or tamper with its communication with our servers. Progress or items gained this way may be removed, and we may suspend the account involved.

// Purchases

Elsewhere has no purchases yet. If we introduce them, we will show the price, the purchase terms and your statutory withdrawal rights before you buy.

4. Your legal rights

Statutory liability rules apply. Mandatory consumer rights remain unaffected. These terms do not exclude rights you have under applicable law.

5. Changes

We may update these terms when our products change. For significant changes we will inform you in the product before they take effect. The date at the top shows the current version.
